DreamWhisper Terms and Conditions

1. Introduction

These Terms and Conditions ("Terms") govern your use of the DreamWhisper mobile application ("App") operated by SP SWE SERVICES LTD, a company registered in the United Kingdom ("we," "us," or "our").

By downloading, installing, or using our App, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use our App.

2. Description of Service

DreamWhisper is a sleep and relaxation application that provides:

• Sleep stories and nighttime audio experiences
• Text-to-speech audio generation using advanced AI technology
• Background soundscape creation and layering
• Guided breathing and wind-down exercises
• Personalized sleep content

Important Note on Content Duration: AI-generated experiences are approximate in length. While you may select a target duration (e.g., 30 minutes), the actual generated content may vary (typically 20-40 minutes) due to the nature of AI content generation.

3. Account and Registration

Currently, the App operates using device-generated identifiers stored securely on your device. No personal registration is required. We may introduce user accounts in future updates, and these Terms will apply to such features.

4. Subscription and Payment Terms

4.1 Service Tiers

• Free Tier: Includes one 5-minute trial audio experience, unlimited script generation, unlimited soundscape creation, and unlimited guided breathing exercises.
• Premium Subscription: Monthly or annual subscription providing 20 credits per billing cycle.

4.2 Auto-Renewable Subscriptions

Subscription Title: DreamWhisper Premium

Subscription Length: Monthly (1 month) or Annual (1 year)

Subscription Price: Current pricing is displayed at the time of purchase and varies by region. Prices are available in the App Store.

4.2.1 Billing and Renewal

• Payment will be charged to your iTunes Account at confirmation of purchase.
• Subscription automatically renews unless auto-renew is turned off at least 24 hours before the end of the current period.
• Your account will be charged for renewal within 24 hours prior to the end of the current period.
• You can manage and cancel your subscriptions by going to your Account Settings on the App Store after purchase.

4.2.2 Cancellation

Subscriptions may be cancelled at any time from your iTunes Account Settings. Refunds will not be provided for any unused portion of the term.

4.3 Credits System

• Audio generation requires credits (1 credit per audio experience).
• Subscription credits are allocated at subscription start and each renewal date.
• Unused subscription credits expire at the end of each billing cycle.

4.4 Pay-As-You-Go Credits

• Individual audio generation credits available for purchase in packages (5-credit and 12-credit options).
• Credit package pricing varies by region and is displayed at the time of purchase.
• Credits do not expire and remain in your account indefinitely.
• No automatic renewal for credit purchases.

4.5 Refunds

• All sales are final, subject to applicable law.
• We may provide credits for experiences that fail to generate due to technical issues.
• Refund requests should be made through Apple's App Store refund process.

5. Acceptable Use Policy

5.1 Permitted Use

You may use the App for personal, non-commercial purposes to create sleep, relaxation, and mindfulness content.

5.2 Prohibited Content

You may not use the App to generate content that:

• Contains hate speech, violence, or discriminatory language.
• Is sexually explicit or inappropriate.
• Violates any applicable laws or regulations.
• Attempts to circumvent content filters ("jailbreaking").
• Is intended to harm, harass, or intimidate others.
• Infringes upon third-party intellectual property rights, including but not limited to the creation of content based on copyrighted characters, fictional personas, or proprietary creative works owned by others without proper authorization.

5.3 Fair Use

While script generation is unlimited, we reserve the right to implement reasonable usage limits to prevent abuse or system overload.

6. Intellectual Property Rights

6.1 Your Content

You retain ownership of all content you generate through the App, including scripts and audio experiences. You may use, share, and distribute your generated content freely, including for commercial purposes.

6.2 Our Property

The App, its design, functionality, algorithms, and underlying technology remain our property. You may not reverse engineer, copy, or create derivative works of the App.

6.3 Third-Party Content

Background sounds may be subject to attribution requirements from freesound.org and other sources. We will provide appropriate attribution where required.

7. AI-Generated Content Disclaimer

7.1 Content Quality

AI-generated content is provided "as-is." While we strive for high-quality outputs, we cannot guarantee:

• Perfect accuracy or appropriateness of generated scripts.
• Exact duration matching your selected preferences.
• Consistency in quality across all generations.

7.2 Content Review

We do not pre-review generated content. If you encounter inappropriate content, please report it to us immediately.

8. Data Collection and Privacy

We collect limited analytical data about app usage, errors, and generated content patterns. No personally identifiable information is collected. Our full privacy practices are detailed in our Privacy Policy.

9. Third-Party Services

The App integrates with various third-party services to provide AI generation, text-to-speech processing, analytics, and hosting capabilities. These services have their own terms and privacy policies. For security and privacy, generated audio files are automatically deleted from processing servers within a short timeframe.

10. Age Restrictions

The App is suitable for users of all ages. However, users under 13 should use the App with parental supervision in compliance with applicable privacy laws.

11. Availability and Service Changes

11.1 Service Availability

We strive to provide continuous service but cannot guarantee uninterrupted access. We may temporarily suspend service for maintenance, updates, or technical issues.

11.2 Feature Changes

We reserve the right to modify, update, or discontinue features with reasonable notice. Significant changes affecting paid features will be communicated in advance.

12. Limitation of Liability

To the maximum extent permitted by law:

• We provide the App "as-is" without warranties of any kind.
• We are not liable for any indirect, incidental, or consequential damages.
• Our total liability is limited to the amount you paid for the App in the 12 months preceding the claim.
• We are not responsible for content generated by AI systems.

13. Indemnification

You agree to indemnify and hold us harmless from any claims, damages, or losses arising from:

• Your use of the App.
• Content you generate or share.
• Your violation of these Terms.
• Your violation of any third-party rights.

14. Termination

14.1 Termination by You

You may stop using the App at any time. To cancel subscriptions, use your device's subscription management settings.

14.2 Termination by Us

We may terminate your access if you violate these Terms, with notice where reasonable.

14.3 Effect of Termination

Upon termination:

• Your access to premium features will cease.
• Unused subscription credits will be forfeited.
• Purchased credits may remain accessible subject to technical limitations.

15. Governing Law and Disputes

These Terms are governed by the laws of England and Wales. Any disputes will be resolved through binding arbitration in the United Kingdom, except where prohibited by law.

17. Changes to Terms

If any provision of these Terms is found invalid or unenforceable, the remaining provisions will continue in full force and effect.

19. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and SP SWE SERVICES LTD regarding the App.

These Terms and Conditions are effective as of 11 August 2025 and apply to all users of DreamWhisper.
